Terms and Conditions of Service

  • “Company” refers to Apt Scaffolding Ltd, hereafter referred to as “the Company.”
  • “Client” refers to the person, partnership, company, or organisation contracting the services of the Company.
  • “Site” refers to the location where the scaffolding services will be provided.
  • “Project” refers to the work to be carried out by the Company at the Site, as specified in the Company’s quotation.
  • All quotations provided by the Company are subject to change until formally accepted by the Client.
  • The Client agrees to pay the fees specified in the quotation, inclusive of all applicable taxes, unless stated otherwise in writing.
  • Any additional work or changes to the scope of the Project will be subject to supplementary charges, as mutually agreed upon by the Company and the Client.
  • If additional works are required, a verbal instruction order may be completed on-site, and the cost will reflect the request from the site. The Company will make every effort to communicate these additional costs to the Client and seek their approval before proceeding with the additional work. Verbal instruction orders must be documented and signed by both the Company and the Client to confirm the agreement.
  • The Company reserves the right to adjust prices with prior notice, reflecting any changes in the cost of materials, labour, or unforeseen circumstances.
  • The Client must provide reasonable notice for booking scaffolding services. The notice period will be specified in the quotation.
  • The Company may not be able to accommodate bookings with insufficient notice.
  • Changes or cancellations to bookings must be communicated in writing and agreed upon by both parties.
  • If scaffolding drawings are required as part of the Project, the Client must provide a minimum of 14 days’ notice to ensure timely production before the project’s start date. The availability of drawings is subject to the Client’s request and will be specified in the quotation. Any additional charges associated with the production of scaffolding drawings will be detailed in the quotation.
  • We reserve the right to change or cancel a booking with at least 24 hours’ notice in case of emergencies or unforeseen circumstances. However, we prioritize delivering a reliable and timely service, and we will communicate any changes to your booking as soon as possible.
  • If your project has strict scheduling constraints, please inform us during booking so that we can prioritise your request and avoid unnecessary changes.
  • In the event of such changes or cancellations initiated by the Company, every effort will be made to reschedule the service at a mutually convenient time for both parties. If rescheduling is not possible, any payments made by the Client for the affected booking will be refunded promptly.
  • The Company is committed to maintaining the highest standards of health and safety in compliance with relevant UK regulations.
  • The Client is responsible for ensuring that all personnel working on the scaffolding adhere to health and safety guidelines.
  • The Company cannot be held liable for the weight the scaffolding imposes on the ground. It is the Client’s responsibility to ensure that the ground is stable and can adequately support the weight of the scaffolding. The Company will provide load-bearing information as per industry standards, and the Client must assess and confirm the suitability of the ground before scaffolding erection.
  • The Client must engage a qualified engineer or competent professional to assess the ground’s load-bearing capacity and suitability for scaffolding installation. Any modifications or ground preparation necessary to support the scaffolding, as recommended by the qualified engineer, will be the responsibility of the Client.
  • The Client is solely responsible for ensuring that all scaffolding has been inspected in the following instances: following installation/before first use, at an interval of no more than every 7 days thereafter, and following any circumstances liable to jeopardize the safety of the installation (e.g., high winds).
  • The Company can offer scaffolding inspection services and will advise the Client of associated costs. If the Client chooses not to use the Company’s inspection services, they must ensure that a competent person, qualified and trained in scaffolding safety, carries out the inspection. The results of these inspections should be documented and retained for record-keeping purposes. Certainly, here are the two additional clauses under “6. Equipment and Materials” as per your request:
  • The Company will provide scaffolding equipment and associated materials as specified in the quotation.
  • The Client is responsible for any damage, loss, or theft of the Company’s equipment during the Project unless caused by the Company’s negligence.
  • The Company will not be responsible for damages caused on-site if the Client has not notified us of the risk prior to the works commencing. The Client must promptly inform the Company of any potential risks or hazards on the Site that may impact the safety or integrity of the scaffolding. Failure to notify the Company of such risks may affect liability for resulting damages.
  • The Client must ensure that they do not overload the scaffolding with materials and must abide by the load specifications provided by the Company through scaffold drawings or TG20 compliance sheets. The Company provides load-bearing information based on industry standards, and it is imperative that the Client adheres to these specifications to maintain the structural integrity and safety of the scaffolding. Overloading the scaffolding may result in structural damage, accidents, and additional costs for repair or reinforcement.
  • The Company maintains appropriate liability insurance coverage.
  • The Client is encouraged to maintain adequate insurance coverage to protect against any potential liabilities associated with the Project.
  • All scaffolding equipment supplied by the Company remains the property of the Company and must not be removed or altered without the Company’s consent.
  • Upon completion of the Project, the Client must promptly notify the Company for the removal of scaffolding equipment.
  • Payment terms are as specified in the invoices.
  • Invoices must be paid by the Client within the agreed-upon timeframe.
  • The Company reserves the right to charge interest on overdue payments as permitted by applicable laws.
  • Any disputes or disagreements between the Company and the Client will be resolved through good-faith negotiations and, if necessary, legal proceedings in accordance with UK laws.
  • Either party may terminate the agreement for breach of contract, subject to written notice.
  • These terms and conditions are governed by and construed in accordance with the laws of England and Wales.
  • These terms and conditions constitute the entire agreement between the Company and the Client, supersedes all prior agreements, and may only be amended in writing.
